2. Definitions

In these Terms, the following definitions apply:

• "Account" means the account created by a User to access and use the Services.
• "Content" means any text, graphics, images, music, software, audio, video, information, or other materials appearing on or through the Services.
• "Order" means a request to purchase Products through the Services.
• "Products" means the fruits, vegetables, and other items offered for sale through the Services.
• "Subscription" means a recurring Order for Products at specified intervals.
• "User" means an individual who accesses or uses the Services.
• "User Content" means any Content that a User posts, uploads, publishes, submits, or transmits to be made available through the Services.

3. Account Registration and Use

3.1 Account Creation

To use certain features of our Services, you may need to register for an Account. When you register, you agree to provide accurate, current, and complete information and to update this information to maintain its accuracy. You are responsible for safeguarding your password and for all activities that occur under your Account. You agree to notify us immediately if you suspect any unauthorized use of your Account.

3.2 Age Requirement

You must be at least 18 years old to create an Account and use our Services. By creating an Account, you represent and warrant that you are at least 18 years old.

3.3 One Account Per User

You may not create more than one Account without our express permission. We reserve the right to terminate any duplicate Accounts.

3.4 Account Termination

We reserve the right to suspend or terminate your Account at any time for any reason, including but not limited to violation of these Terms. You may also terminate your Account at any time by contacting our customer service.

4. Intellectual Property Rights

4.1 Our Content

All content on the SmartMoneys Learning platform, including but not limited to text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of SmartMoneys Learning or its content suppliers and is protected by international copyright laws.

4.2 License to Use Our Content

When you purchase a course or other digital product, we grant you a limited, non-exclusive, non-transferable license to access and use the content for personal, non-commercial purposes. You may not:

• Copy, reproduce, republish, upload, post, transmit, or distribute materials from the courses in any way
• Sell, resell, or use the content for any commercial purpose
• Modify, create derivative works, reverse engineer, or reverse compile any content
• Remove any copyright or other proprietary notations
• Transfer the materials to another person
• Share your account access with others

4.3 User Content

By submitting any content to our platform (such as comments, feedback, or testimonials), you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable right to use, reproduce, publish, distribute, display, and transmit this content for the purposes of providing and promoting our services.

4.4 Copyright Infringement

If you believe that any content on our site infringes upon your copyright, please notify us at [email protected]. Your notice should include:

• A description of the copyrighted work you claim has been infringed
• The location on our site where the allegedly infringing material is located
• Your contact information
• A statement that you have a good faith belief that the disputed use is not authorized
• A statement, made under penalty of perjury, that the information in your notice is accurate

5. Purchases and Payment

5.1 Pricing and Availability

All prices are shown in Polish Zloty (PLN) and include applicable taxes. We reserve the right to change prices for products displayed at any time, and to correct pricing errors that may inadvertently occur.

5.2 Payment Methods

We accept payment via credit card, debit card, PayPal, and bank transfer. By submitting an order, you authorize us to charge the account you specify for the purchase amount.

5.3 Subscription Payments

For subscription-based services, you authorize us to charge your payment method on a recurring basis until your subscription is terminated. You can cancel your subscription at any time through your account settings or by contacting customer service.

5.4 Refunds

Our refund policy for different types of products is as follows:

• Digital Products and Courses: We offer a 14-day money-back guarantee for most digital products. If you are not satisfied with your purchase, you can request a refund within 14 days of purchase by contacting [email protected].
• Live Webinars and Events: Refunds are available up to 7 days before the scheduled event. Cancellations made less than 7 days before the event may be eligible for a partial refund or credit.
• Consulting Services: Refunds for consulting services are handled on a case-by-case basis and depend on the amount of service already provided.

6. User Conduct

When using our services, you agree not to:

• Violate any applicable laws or regulations
• Infringe the intellectual property rights of others
• Transmit any material that is harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity
• Interfere with or disrupt the operation of the services or servers or networks connected to the services
• Attempt to gain unauthorized access to any portion of the services, other accounts, computer systems, or networks connected to the services
• Use any automated systems, such as robots, crawlers, or scrapers, to access the services
• Engage in any behavior that could damage, disable, overburden, or impair the services
• Collect or store personal data about other users without their consent

7. Limitation of Liability

To the fullest extent permitted by applicable law, SmartMoneys Learning, its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the services
• Any conduct or content of any third party on the services
• Any content obtained from the services
• Unauthorized access, use, or alteration of your transmissions or content

In no event shall our total liability to you for all claims related to the services exceed the amount paid by you to SmartMoneys Learning during the twelve (12) month period preceding the event giving rise to such liability.

8. Disclaimer of Warranties

The services are provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied, including but not limited to, warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that:

• The services will meet your specific requirements
• The services will be uninterrupted, timely, secure, or error-free
• The results that may be obtained from the use of the services will be accurate or reliable
• The quality of any products, services, information, or other material purchased or obtained by you through the services will meet your expectations
• Any errors in the services will be corrected

9. Indemnification

You agree to defend, indemnify, and hold harmless SmartMoneys Learning, its officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with:

• Your access to or use of the services
• Your violation of these Terms
• Your violation of any third-party right, including without limitation any intellectual property right, publicity, confidentiality, property, or privacy right
• Any claim that your user content caused damage to a third party

10. Modifications to the Services and Terms

We reserve the right, at our sole discretion, to change, modify, add, or remove portions of these Terms at any time. We will provide notice of changes by posting the updated Terms on our website. Your continued use of the services following the posting of changes constitutes your acceptance of such changes.

We also reserve the right to modify or discontinue, temporarily or permanently, the services or any features or portions thereof without prior notice. You agree that we will not be liable for any modification, suspension, or discontinuance of the services or any part thereof.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms, including any question regarding its existence, validity, or termination, shall be referred to and finally resolved by the competent courts in Warsaw, Poland.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole, and such provisions shall be deleted without affecting the remaining provisions herein.

13. Entire Agreement

These Terms constitute the entire agreement between you and SmartMoneys Learning regarding the use of the services, superseding any prior agreements between you and SmartMoneys Learning relating to your use of the services.
